摘要:随着信息化的演进,BIM技术正以其独特优势在工程领域迅速普及和推广。然而,作为一项发展中的新技术,BIM在实际应用中存在多方面的障碍,其中,法律问题引起了研究者和从业人员的重视,但目前在国内却没有相应的研究成果。因此,本文采用文献综述的研究方法,从权属关系、责任和合同三个方面,梳理了国外研究BIM应用中出现的法律问题所取得的成果,为今后在中国语境下开展这一领域的研究和司法实践打下基础。
Abstract: With the development of informatization in the construction industry, the BIM technology has been rapidly popularized and implemented due to its unique advantages. However, as an evolving technology, BIM still faces many obstacles in the practical application. Among them, the legal issues have already attracted many attentions of researchers and practitioners, which, however, is lacking of corresponding research results in China. Thus, this paper adopts the method of literature review to analyze the legal issues existed in the BIM application in foreign countries from three aspects of ownership, responsibility and contract relationship, which will certainly lay a good foundation for the future research and judicial practice in this field in China.
